Hatfield United States Federal Courthouse<\/a> here in Portland, \u00a0if you want to come watch.<\/span><\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/www.pdxtc.com\/wpblog\/wp-content\/uploads\/3-31-2014-1-07-56-PM.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-3419\" alt=\"an\u00b7ti\u00b7trust ?ant??tr?st,?ant?-\/Submit adjective 1. of or relating to legislation preventing or controlling trusts or other monopolies, with the intention of promoting competition in business.\" src=\"https:\/\/www.pdxtc.com\/wpblog\/wp-content\/uploads\/3-31-2014-1-07-56-PM.jpg\" width=\"509\" height=\"159\" srcset=\"https:\/\/www.pdxtc.com\/wpblog\/wp-content\/uploads\/3-31-2014-1-07-56-PM.jpg 509w, https:\/\/www.pdxtc.com\/wpblog\/wp-content\/uploads\/3-31-2014-1-07-56-PM-300x93.jpg 300w\" sizes=\"(max-width: 509px) 100vw, 509px\" \/><\/a><\/p>\n<h5>WTF?<\/h5>\n<p>What&#8217;s the basis for this lawsuit?<\/p>\n<p>Well, we maintain that after Google notifies a user of an organic search ranking penalty, they are conspiring to intentionally provide site owners with false, incomplete, and misleading data through their &#8220;tools&#8221;, thereby prolonging the time it takes to get a reinclusion request\u00a0approved.<\/p>\n<p>In turn, that unfairly induces site owners to spend money on Google AdWords, their only viable option to get traffic, \u00a0just so they can remain in business. \u00a0Let me explain this in layman&#8217;s terms, and give you a little background in what&#8217;s happening.<\/p>\n<h5>History<\/h5>\n<p>In the old days, your site either ranked or it didn&#8217;t, and aside from theorizing, you really didn&#8217;t know why. An industry was born, the world began to learn the\u00a0basics of SEO &#8211; Search Engine Optimization&#8221;.<\/p>\n<p>In early 2002, Google released something called\u00a0<a href=\"http:\/\/www.google.com\/webmasters\/\" target=\"_blank\" rel=\"noopener noreferrer\">Google Webmaster tools<\/a>\u00a0and by early 2003, Google had established the constantly evolving &#8220;rules of the game&#8221; that they call the\u00a0<a href=\"https:\/\/support.google.com\/webmasters\/answer\/35769?hl=en\" target=\"_blank\" rel=\"noopener noreferrer\">Webmaster Guidelines<\/a>.<\/p>\n<p style=\"text-align: left;\"><span style=\"line-height: 1.5em;\">This was fantastic. \u00a0This gave us in the industry some actual tools to help us do our job,\u00a0and the progress in the tools has been amazing.<\/span><\/p>\n<h5>Google Provides the Tools<\/h5>\n<p>Today we can do everything from feed Google sitemaps of our sites, verify domain ownership, grant access to others, monitoring hacking, and get SEO\u00a0suggestions.<\/p>\n<p>There is even a tool that examines technical site performance related to our <a href=\"http:\/\/developers.google.com\/speed\/pagespeed\/insights\/\" target=\"_blank\" rel=\"noopener noreferrer\">speed and compatibility<\/a> with computers and mobile devices around the\u00a0world.<\/p>\n<p><span style=\"line-height: 1.5em;\">Sounds great, right? It actually is Webmaster tools is an amazing thing, and without it, domain owners could not be in charge of their own destiny. The world\u00a0continues to thank Google for Webmaster Tools, and I&#8217;m among its most avid supporters.<\/span><\/p>\n<h5>Backlinks:<\/h5>\n<p>Now as a layperson, you need to know that besides the content and code on your website, search engine optimization also has to do with some external factors, and the most important over the years has been links.<\/p>\n<p>Having others linking to your website was a far stronger factor than anything you might have on your webpage, \u00a0and people began to realize this. When they linked, how they linked, where they linked, and even what words they linked with, \u00a0all are considered in a way that would boggle your mind.<\/p>\n<p>Let&#8217;s just say that the evolution of &#8220;backlinks&#8221; and how they effect your Google rankings has changed a lot over the past 15 years and I&#8217;ll try not to get too technical.<\/p>\n<h5>The Evolution<\/h5>\n<p>In the early 2000&#8217;s more and more people were writing about &#8220;SEO&#8221;, and even SEO conferences began, where people learned more and more, sort of &#8220;figuring out\u00a0the system&#8221; of how backlinks could move rankings, and cottage businesses boomed that were selling links.<\/p>\n<p>Google began publicly denouncing these paid &amp; manipulative links, and in 2006 began <a href=\"http:\/\/www.mattcutts.com\/blog\/notifying-webmasters-of-penalties\/\" target=\"_blank\" rel=\"noopener noreferrer\">notifying Webmasters of penalties<\/a>, all the while people\u00a0continued to manipulate and exploit rankings.<\/p>\n<p>Things got so bad that in 2006, \u00a0<a href=\"https:\/\/twitter.com\/mattcutts\" target=\"_blank\" rel=\"noopener noreferrer\">Matt Cutts of Google<\/a> publicly <a href=\"http:\/\/moz.com\/blog\/matt-cutts-calls-out-link-network\" target=\"_blank\" rel=\"noopener noreferrer\">denounced upcoming speaker<\/a> <a href=\"http:\/\/www.searchenginejournal.com\/textlinkads-interview-on-seo-link-advertising-blogs\/2939\/\" target=\"_blank\" rel=\"noopener noreferrer\">Patrick Gavin<\/a> of Text Link Ads at <a href=\"http:\/\/www.pubcon.com\" target=\"_blank\" rel=\"noopener noreferrer\">Pubcon<\/a>. \u00a0Things really came to a head in 2007 when Google even <a href=\"http:\/\/www.seroundtable.com\/archives\/007333.html\" target=\"_blank\" rel=\"noopener noreferrer\">penalized MSN<\/a>, and\u00a0<a href=\"http:\/\/www.mattcutts.com\/blog\/how-to-report-paid-links\/\" target=\"_blank\" rel=\"noopener noreferrer\">Matt Cutts announced how to report paid links<\/a>. Finally, in \u00a02009 Google even developed a special form to <a href=\"https:\/\/www.google.com\/webmasters\/tools\/paidlinks?hl=en\" target=\"_blank\" rel=\"noopener noreferrer\">report for your competitors<\/a>\u00a0who were cheating.<\/p>\n<h5>Some Links Can Hurt You<\/h5>\n<p>Paid links could hurt you, and the most publicized example of this took place in early 2011, \u00a0known to this day as the <a href=\"http:\/\/searchengineland.com\/new-york-times-exposes-j-c-penney-link-scheme-that-causes-plummeting-rankings-in-google-64529\" target=\"_blank\" rel=\"noopener noreferrer\">JCPenney link scandal<\/a>\u00a0 (broken by the <a href=\"http:\/\/www.nytimes.com\/2011\/02\/13\/business\/13search.html?pagewanted=all&amp;_r=0\" target=\"_blank\" rel=\"noopener noreferrer\">New York Times<\/a>\u00a0), and that&#8217;s when I think Google REALLY decided to <a href=\"http:\/\/www.seochat.com\/c\/a\/search-engine-news\/what-the-jc-penney-link-buying-scandal-means-for-seo\/\" target=\"_blank\" rel=\"noopener noreferrer\">change the rules<\/a> permanently, by allowing not just PAID links to hurt you, but ANY links it deems inappropriate.<\/p>\n<p><span style=\"line-height: 1.5em;\">Over the next couple of years, with all of the <a href=\"http:\/\/www.highrankings.com\/dear-google-290\" target=\"_blank\" rel=\"noopener noreferrer\">whining about &#8220;backlink manipulation<\/a>&#8221; culminating in the <a href=\"http:\/\/moz.com\/blog\/how-google-makes-liars-out-of-the-good-guys-in-seo\" target=\"_blank\" rel=\"noopener noreferrer\">public shaming of Google<\/a>\u00a0by <a href=\"https:\/\/twitter.com\/wilreynolds\" target=\"_blank\" rel=\"noopener noreferrer\">Wil Reynolds<\/a>\u00a0of <a href=\"http:\/\/www.seerinteractive.com\/blog\/\" target=\"_blank\" rel=\"noopener noreferrer\">SEER Interactive<\/a> in <a href=\"http:\/\/www.sempdx.org\/searchfest\/2012-agenda\/\" target=\"_blank\" rel=\"noopener noreferrer\">his SearchFest<\/a> <a href=\"http:\/\/www.slideshare.net\/wilreynolds\/searchfest-keynote\" target=\"_blank\" rel=\"noopener noreferrer\">2012 keynote<\/a> coming to a head, on April 24th 2012, where\u00a0<\/span><span style=\"line-height: 1.5em;\">Google officially changed the rules with something <a href=\"http:\/\/searchengineland.com\/google-launches-update-targeting-webspam-in-search-results-119295\" target=\"_blank\" rel=\"noopener noreferrer\">they called &#8220;Penguin&#8221;<\/a>.<\/span><\/p>\n<h5>Under Penguin<\/h5>\n<p>The exact same links to your website that used to help you rank higher, not only &#8220;don&#8217;t count&#8221; any more, but suddenly they can hurt you algorithmically\u00a0too, in Google.<\/p>\n<p>This change to the fundamental way that Google worked not only punished the evil doers, but was widely applauded, and seen as long overdue by many in the industry. \u00a0It really was about time Google cleaned up the mess they had created.<\/p>\n<p><span style=\"line-height: 1.5em;\">Even better, to help the site owner &#8220;get out of the doghouse&#8221; Google provides us with the tools and resources we need right inside of\u00a0Webmaster tools so we don&#8217;t have to suffer this loss of revenue forever, and they can help us help ourselves.<\/span><\/p>\n<h5>This is All Just Wonderful<\/h5>\n<p>Google is cleaning up their act, and they&#8217;re helping us clean up ours, so how can this be a bad thing? \u00a0What possible basis can there be for a lawsuit?<\/p>\n<p>To be clear, Google has a right to penalize anyone for anything they want, since the search index is theirs to do with as they wish. However, I maintain they\u00a0do not have the right to cause financial harm to a business by <em><strong>discriminating against them<\/strong><\/em> in the search results without providing the correct information for the removal of that penalty.<\/p>\n<p>I also maintain that by providing us with this misinformation they are intentionally stringing us along, and are thereby inducing us to increase \u00a0or begin buying Google visitors through the use of their advertising platform called <a href=\"http:\/\/www.google.com\/adwords\" target=\"_blank\" rel=\"noopener noreferrer\">Google Adwords<\/a>.<\/p>\n<h5>What Misinformation?<\/h5>\n<p>I&#8217;ll get to that, but first you need a\u00a0little more background:<\/p>\n<p>When Google determines through various methods that a webmaster has engaged in what they consider to be &#8220;bad practices&#8221;, they send an e-mail to the webmaster<br \/>\nand webmaster tools saying that the site has been penalized.\u00a0A sample letter looks something like this:<\/p>\n<blockquote><p>We&#8217;ve detected that some of the links pointing to your site are using techniques outside Google&#8217;s Webmaster Guidelines.<br \/>\nWe don&#8217;t want to put any trust in links that are artificial or unnatural. We recommend removing any unnatural links to your site. However, we do realize that<br \/>\nsome links are outside of your control.<\/p>\n<p>As a result, for this specific incident we are taking very targeted action on the unnatural links instead of your site as a whole. If you are able to remove<br \/>\nany of the links, please submit a reconsideration request, including the actions that you took.<br \/>\nIf you have any questions, please visit our Webmaster Help Forum.<\/p><\/blockquote>\n<p>At that point, the webmaster has to begin the process of requesting reinclusion, and Matt Cutts outlines the process here in this video:<\/p>\n<div align=\"center\"><iframe loading=\"lazy\" src=\"\/\/www.youtube.com\/embed\/8MfPe1NbsoA?rel=0\" height=\"253\" width=\"450\" allowfullscreen=\"\" frameborder=\"0\"><\/iframe><\/div>\n<p>This is the basic &#8220;full process&#8221; for getting back in Google&#8217;s good graces:<\/p>\n<ol>\n<li>Identify the offending links<\/li>\n<li><span style=\"line-height: 1.5em;\">Disavow those links using the <a href=\"https:\/\/www.google.com\/webmasters\/tools\/disavow-links-main\" target=\"_blank\" rel=\"noopener noreferrer\">Google disavow tool<\/a>\u00a0<\/span><\/li>\n<li><span style=\"line-height: 1.5em;\">Make a good-faith effort to have them removed, by embarking upon an e-mail campaign to the webmasters.<\/span><\/li>\n<li><span style=\"line-height: 1.5em;\">Request <a href=\"https:\/\/www.google.com\/webmasters\/tools\/reconsideration\" target=\"_blank\" rel=\"noopener noreferrer\">reconsideration here<\/a>, including a detailed documentation of your removal efforts and a well-written <a href=\"http:\/\/moz.com\/ugc\/the-anatomy-of-a-successful-reconsideration-request\" target=\"_blank\" rel=\"noopener noreferrer\">mia-culpa letter<\/a><\/span><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>At that point Google will re-examine your situation, and will either accept or deny your reinclusion request. When they deny your request, they will provide examples of remaining links in your backlink profile that you have failed to identify in either your attempts at removal, or in your disavow file that you&#8217;ve \u00a0uploaded to webmaster tools.<\/p>\n<p>Quite often the example links that Google dredges to show you are more than five years old and in some cases, like this one below, the &#8220;bad link&#8221; might even come from another property that Google owns!<\/p>\n<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter  wp-image-3424\" alt=\"A bad link example from Google after a reinclusion denial, showing a link dating back to 2007\" src=\"https:\/\/www.pdxtc.com\/wpblog\/wp-content\/uploads\/3-31-2014-1-27-09-PM.jpg\" width=\"466\" height=\"433\" srcset=\"https:\/\/www.pdxtc.com\/wpblog\/wp-content\/uploads\/3-31-2014-1-27-09-PM.jpg 823w, https:\/\/www.pdxtc.com\/wpblog\/wp-content\/uploads\/3-31-2014-1-27-09-PM-300x278.jpg 300w\" sizes=\"(max-width: 466px) 100vw, 466px\" \/><\/p>\n<p>&nbsp;<\/p>\n<h5>That&#8217;s Where Things Have Gone Wrong<\/h5>\n<p>Google gives us the information to undertake the process by\u00a0providing details webmaster tools that show who is linking to you, and they identify the linking URL and anchor text of the<br \/>\nlink.<\/p>\n<p>Webmasters have a lot of work to do contacting site owners, combing through links manually, and determining with their best efforts<br \/>\nwhich ones are acceptable and which ones could potentially be harmful.<\/p>\n<p>&nbsp;<\/p>\n<h5>The Lawsuit<\/h5>\n<p>I believe that Google is intentionally feeding us false information in order to profit financially.<\/p>\n<p>Unfortunately, despite the best efforts of internet marketing professionals, users are repeatedly being denied reinclusion, and then they are provided by Google with examples of<br \/>\n&#8220;bad links&#8221; that are *not* shown to the site owner in Google Webmaster tools.<\/p>\n<p>For example, <a href=\"https:\/\/productforums.google.com\/forum\/#!topic\/webmasters\/38Lw5xEzzto\" target=\"_blank\" rel=\"noopener noreferrer\">here\u00a0is a user<\/a>\u00a0 that says \u00a0&#8211;<\/p>\n<blockquote><p><em>Our problem is that Google continues to find sample URLs of unnatural links pointing our site that don&#8217;t exist in our Webmaster tools list of backlinks, nor in our Moz list of backlinks, nor in our link detox list of backlinks&#8230;<\/em><\/p><\/blockquote>\n<p>Here&#8217;s <a href=\"https:\/\/productforums.google.com\/forum\/#!category-topic\/webmasters\/ga3vI8Y2RtA\" target=\"_blank\" rel=\"noopener noreferrer\">another user<\/a>, an experienced <a href=\"https:\/\/twitter.com\/Marie_Haynes\">professional in the art of reinclusion<\/a>, that says this after being denied, referring to one of the &#8220;example links&#8221; that Google provided:<\/p>\n<blockquote><p><em>That link is not listed in the list of links that I have downloaded by going to Links to your site&#8211;&gt;More&#8211;&gt;Download latest links. \u00a0Just to be sure, I downloaded them again and it is not there. \u00a0I also downloaded &#8220;More sample links&#8221; and it is not in there<\/em><\/p><\/blockquote>\n<p>I could go on and on with more examples, but I think you get the idea. \u00a0How can you be expected to get out of organic penalty when Google keeps &#8220;moving the bar&#8221; and coming back with more examples of &#8220;bad links&#8221; \u00a0that they are not showing you?<\/p>\n<h5>Google Has Lied<\/h5>\n<p>Google and it&#8217;\u00a0employees have repeatedly said things that have turned out to be untrue. For example, John Mueller, in a <a href=\"http:\/\/dejanseo.com.au\/link-cleanup\/\" target=\"_blank\" rel=\"noopener noreferrer\">Webmaster Tools Video Hangout<\/a> said this:<\/p>\n<blockquote><p><em>&#8230;you can find all the links you need for webspam or algorithmic reasons in webmaster tools. So it\u2019s not the case that you would need a third party or an external tool to kind of dig up all of those links to find the ones that are problematic&#8230;<\/em><\/p><\/blockquote>\n<p>Barry Schwartz at \u00a0Search Engine Roundtable was one of the first to report that <a href=\"http:\/\/www.seroundtable.com\/google-disavow-webmaster-tools-16871.html\" target=\"_blank\" rel=\"noopener noreferrer\">Google says they are giving us all we need<\/a> pointed out the <a href=\"http:\/\/www.seroundtable.com\/google-webmaster-tools-links-not-inclusive-17198.html\" target=\"_blank\" rel=\"noopener noreferrer\">hypocracy here<\/a>\u00a0saying this:<\/p>\n<blockquote><p><em>Marie Haynes posted topic in the\u00a0Google Webmaster Help\u00a0forums where she said a client of hers received an unnatural link notification from Google but the example inorganic link cited by Google was no where to be found in Google Webmaster Tools link report.<\/em><\/p><\/blockquote>\n<h5 style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter  wp-image-3440\" title=\"Google Said Webmaster Tools Links Is Enough But It Is Not!\" alt=\"Google Said Webmaster Tools Links Is Enough But It Is Not!\" src=\"https:\/\/www.pdxtc.com\/wpblog\/wp-content\/uploads\/3-31-2014-2-19-50-PM.jpg\" width=\"468\" height=\"285\" srcset=\"https:\/\/www.pdxtc.com\/wpblog\/wp-content\/uploads\/3-31-2014-2-19-50-PM.jpg 650w, https:\/\/www.pdxtc.com\/wpblog\/wp-content\/uploads\/3-31-2014-2-19-50-PM-300x182.jpg 300w\" sizes=\"(max-width: 468px) 100vw, 468px\" \/><\/h5>\n<h5>Who Actually Benefits From the Lie?<\/h5>\n<p>Why, GOOGLE DOES of course! When faced with a drop in traffic and repeated denials for reconsideration, site owners only have one option if they want to get back their traffic, and that is spending money on Google Adwords.<\/p>\n<p>With Google dragging out the process of reinclusion over a period of months, \u00a0and by repeatedly citing more and more &#8220;examples&#8221; of bad links which they should have shown us in the first place, we are being indirectly pressured to spend money in Google Adwords if we don&#8217;t want to go out of business!<\/p>\n<h5><span style=\"line-height: 1.5em;\">Who Can Join The Lawsuit?<\/span><\/h5>\n<p><span style=\"line-height: 1.5em;\">My attorney, \u00a0who only weeks ago began working at the\u00a0<\/span><a style=\"line-height: 1.5em;\" href=\"http:\/\/www.injurylaworegon.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Peterson Law Offices<\/a><span style=\"line-height: 1.5em;\">, believes that there may be hundreds of thousands of potential claimants out there. He may just want to make<\/span><span style=\"line-height: 1.5em;\">\u00a0a name for himself, but he&#8217;s taking it totally on contingency.\u00a0<\/span><\/p>\n<p>His parents were forced to close their online business after their ecommerce site went from \u00a07.1 million dollars in annual revenue to less than $18,000 in their last full month of operation, so he has a personal interest.<\/p>\n<p>Lastly, <a href=\"https:\/\/twitter.com\/Michael512\" target=\"_blank\" rel=\"noopener noreferrer\">I&#8217;m<\/a> <a href=\"https:\/\/twitter.com\/graywolf\" target=\"_blank\" rel=\"noopener noreferrer\">also<\/a> <a href=\"https:\/\/twitter.com\/johnandrews\" target=\"_blank\" rel=\"noopener noreferrer\">already<\/a> <a href=\"https:\/\/twitter.com\/stuntdubl\" target=\"_blank\" rel=\"noopener noreferrer\">reaching<\/a> <a href=\"https:\/\/twitter.com\/toddmintz\" target=\"_blank\" rel=\"noopener noreferrer\">out<\/a> <a href=\"https:\/\/twitter.com\/oilman\" target=\"_blank\" rel=\"noopener noreferrer\">to<\/a> <a href=\"https:\/\/twitter.com\/randfish\" target=\"_blank\" rel=\"noopener noreferrer\">others<\/a> <a href=\"https:\/\/twitter.com\/davidmihm\" target=\"_blank\" rel=\"noopener noreferrer\">in<\/a> <a href=\"https:\/\/twitter.com\/shoemoney\" target=\"_blank\" rel=\"noopener noreferrer\">the<\/a> <a href=\"https:\/\/twitter.com\/GregBoser\" target=\"_blank\" rel=\"noopener noreferrer\">industry<\/a> <a href=\"https:\/\/twitter.com\/dannysullivan\" target=\"_blank\" rel=\"noopener noreferrer\">asking<\/a> <a href=\"https:\/\/twitter.com\/aaronwall\" target=\"_blank\" rel=\"noopener noreferrer\">them to<\/a> <a href=\"https:\/\/twitter.com\/rustybrick\" target=\"_blank\" rel=\"noopener noreferrer\">spread<\/a> <a href=\"https:\/\/twitter.com\/BruceClayInc\" target=\"_blank\" rel=\"noopener noreferrer\">the<\/a> <a href=\"https:\/\/twitter.com\/LisaBarone\" target=\"_blank\" rel=\"noopener noreferrer\">word<\/a>. The general consensus is, that this thing could be winnable.<\/p>\n<h5>So? \u00a0Who&#8217;s with me?
